MS Competitions — Terms and Conditions

1. The Promoter

MS Competitions is operated by Gareth Parker trading as MS Competitions (“the Promoter”).

Website: www.mscompetitions.co.uk

Address: 11A High Street, Cullompton, Devon, EX15 1AB

Email: [email protected]

2. Competitions

These Terms and Conditions apply to all competitions, prize draws, instant win promotions and autodraw competitions operated by the Promoter through the Website.

Each Competition will have its own prize, entry price, closing date, maximum entries and any specific rules displayed on the relevant Competition page.

Every Competition offers both a paid entry route and a free postal entry route.

Competitions will end when the advertised timer expires or when all available entries have been allocated, whichever occurs first.

The Promoter will not extend a Competition solely to sell additional entries.

3. Eligibility

Entrants must:

  • Be aged 18 years or over.
  • Be residents of the United Kingdom.
  • Provide accurate and complete contact details.

Employees of the Promoter and anyone professionally connected with a Competition may not enter.

By entering a Competition, you confirm that:

  • You have read and accepted these Terms and Conditions.
  • You are legally entitled to participate.
  • You are not breaching any laws applicable to you by entering.

All Competitions are governed by the laws of England and Wales.

4. How To Enter

To enter a Competition, you must create an account on the Website and either:

  • Purchase entries online; or
  • Submit a valid free postal entry.

An entry is only valid once it has been successfully received and processed by the Promoter.

The Promoter reserves the right to refuse or cancel an entry where it reasonably believes these Terms and Conditions have been breached or where fraud, abuse or misuse is suspected.

All entries are final and non-refundable except where expressly stated in these Terms.

5. Free Postal Entry Route

The Promoter offers a free postal entry route for every Competition.

To enter by post, entrants must send a clearly handwritten entry on an open postcard stating:

  • The Competition they wish to enter;
  • Their full name;
  • Postal address;
  • Email address;
  • Telephone number; and
  • Confirmation that they have read and agree to be bound by these Terms and Conditions.

Postal entries should be sent to:

MS Competitions
11A High Street
Cullompton
Devon
EX15 1AB

Entrants must hold a registered account on the Website. The details provided on the postcard must match the details registered to the entrant’s account. This requirement is solely for verification and administration purposes and does not affect the free nature of the postal entry route.

Only one entry is permitted per postcard.

Postal entries must be submitted through the Royal Mail postal system with the correct postage paid. Hand-delivered entries, bulk entries, entries delivered directly through the Promoter’s letterbox, or multiple entries submitted within a single envelope will not be accepted.

Postal entries must be received at least one full working day before the advertised Competition closing date and time to allow sufficient time for processing.

Entries are allocated on a first-come, first-served basis, subject to availability. If all available entries for a Competition have already been allocated when a postal entry is received, that entry will be void and will not be entered into the Competition.

Once a valid postal entry has been received and processed, the Promoter will allocate an entry number and confirm the entry either by email or within the entrant’s online account.

Each valid postal entry has the same chance of winning a Prize or Instant Win Prize as a paid online entry.

The Promoter accepts no responsibility for postal entries that are lost, delayed, misdirected, damaged or not delivered. Entrants are advised to obtain proof of posting.

6. Entry Limits

Each Competition may have a maximum number of entries per person. Any limits will be displayed on the Competition page.

Each Competition will have a minimum of nine (9) entries and a maximum of 999,999 entries unless otherwise stated.

Each valid entry is automatically eligible for any Instant Win prizes associated with that Competition.

7. Winner Selection

All winners will be selected using a verifiably random number generation process.

Draws may be conducted live on Facebook, YouTube, X or any other platform chosen by the Promoter.

For Autodraw Competitions, the Website software may automatically select the winner once the Competition ends or sells out.

Instant Win prizes are allocated using predetermined winning numbers generated before the Competition begins.

The Promoter’s decision is final.

8. Winner Notification

Winners will be contacted using the contact details provided at the time of entry.

It is your responsibility to ensure your details remain accurate and up to date.

Winners may be required to provide proof of identity and proof of age before a prize is awarded.

If a winner:

  • Cannot be contacted;
  • Fails to respond within fourteen (14) days;
  • Fails verification checks; or
  • Is otherwise disqualified,

the Promoter reserves the right to withdraw the prize or select an alternative winner.

9. Prizes

Prizes will be awarded as advertised.

Where offered, winners may choose a cash alternative set by the Promoter.

Delivery within Great Britain is free unless otherwise stated.

The Promoter reserves the right to substitute a prize with an alternative of equal or greater value where reasonably necessary.

Once a prize has been delivered or collected, responsibility for the prize passes to the winner.

Any taxes, duties, insurance, registration costs or ongoing expenses associated with a prize are the responsibility of the winner.

10. Prize Storage

The Promoter will store a prize free of charge for up to thirty (30) days after notifying the winner.

Any storage required beyond thirty (30) days may be charged to the winner at a reasonable cost.

11. Winner Publicity

Winners may be invited to participate in publicity, photographs, videos, testimonials and social media content.

Participation is entirely voluntary and is not a condition of receiving a prize.

The Promoter may publish a winner’s first name, surname initial and county of residence to demonstrate that a valid award has taken place.

Entrants may object to publication by contacting the Promoter, although winner information may still be provided to regulatory authorities where required.

12. Multiple Accounts and Unfair Conduct

Each person may hold one account only.

The use of multiple accounts, automated systems, scripts, bots, syndicates or any method intended to gain an unfair advantage is prohibited.

The Promoter may suspend, merge, restrict or close accounts and may void associated entries, credits or prizes where a breach of this clause is reasonably suspected.

13. Fraud Prevention

The Promoter reserves the right to investigate suspected fraud or abuse.

During any investigation, the Promoter may withhold, suspend or cancel entries, credits, prizes or accounts.

14. Safe Play

The Promoter wants participation in Competitions to remain enjoyable and affordable. Entrants are responsible for ensuring that their participation and spending remain within their personal means.

Safe Play tools may be available through the Website, including spending limits, cooling-off periods and account closure. Entrants may also contact the Promoter to request assistance with applying an available restriction.

Where the Promoter reasonably identifies activity that may indicate excessive, unusually frequent or potentially harmful participation, the Promoter may contact the entrant and may temporarily restrict the entrant from making further paid purchases while the activity is reviewed.

Following a review, the Promoter may apply a reasonable spending limit, cooling-off period or restriction on future paid participation. Where appropriate, the Promoter may close the entrant’s account to future purchases.

Any restriction will be applied in good faith, proportionately and for the purpose of protecting the entrant. Unless there is a separate breach of these Terms, a Safe Play restriction will not invalidate entries already validly purchased or remove an entrant’s entitlement to a prize already validly won.

Account restrictions do not affect an entrant’s right to withdraw or receive any cash prize or other sum already payable. The treatment of unused account credit will be explained to the entrant when a restriction is applied.

Entrants must not attempt to circumvent a spending limit, cooling-off period, exclusion or account restriction by opening another account, using another person’s account or providing different personal details. Any such attempt will constitute a breach of these Terms.

15. Data Protection

Personal information will be processed in accordance with the Promoter’s Privacy Policy.

Information may be used to:

  • Administer Competitions.
  • Verify winners.
  • Deliver prizes.
  • Prevent fraud.
  • Comply with legal obligations.

Where necessary, information may be shared with service providers, delivery partners, payment providers or regulatory authorities.

16. Limitation of Liability

Nothing in these Terms excludes liability that cannot legally be excluded.

Subject to that, the Promoter shall not be liable for indirect, consequential or economic losses arising from participation in a Competition.

The maximum liability of the Promoter shall not exceed the value of the relevant prize or, for non-winning entrants, the amount paid by that entrant to participate.

17. Website and Account Use

You are responsible for maintaining the security of your account and password.

You must not:

  • Share your account.
  • Attempt to interfere with the Website.
  • Upload malicious software.
  • Use the Website for unlawful purposes.
  • Infringe the rights of others.

The Promoter reserves the right to suspend or terminate accounts where these Terms are breached.

18. Changes and Cancellation

The Promoter may amend these Terms from time to time.

The latest version will always be published on the Website.

The Promoter reserves the right to amend, suspend or cancel a Competition where reasonably necessary due to operational, technical or legal reasons.

Where a Competition is cancelled, paid entrants will be offered either a refund or account credit.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any provision shall not constitute a waiver of that provision.

The Promoter shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, power failures, telecommunications failures, government action, terrorism, war or civil unrest.

These Terms and Conditions constitute the entire agreement between the Entrant and the Promoter in relation to Competitions operated through the Website.
